01 Acceptance of Terms

These Terms of Service ("Terms") form a binding legal agreement between you ("you," "streamer," or "user") and AuraStream ("AuraStream," "we," "us," or "our") governing your access to and use of our real-time AI video transformation platform, including our website, applications, APIs, dashboards, and related services (collectively, the "Service"). AuraStream exists so streamers can present themselves however they choose, live and without a render queue — but that creative freedom ends the instant it is used to deceive a real person, exploit a minor, or harass someone. Everything that follows exists to protect the first idea by drawing a firm, enforceable line around the second.

By creating an account, purchasing minutes, starting a session, or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you are accessing the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and the organization. If you do not agree to every part of these Terms, you must not access or use the Service.

02 Definitions

To keep the rest of this document readable, a handful of terms carry a specific meaning throughout: "Source Content" means the raw video and audio you feed into the Service. "Output Content" means the transformed video and audio the Service generates from your Source Content during a session. "Minutes" means the unit of consumable credit used to measure active transformation time. "Session" means a continuous period during which the Service is actively transforming your feed. "Likeness" means any recognizable depiction of a real person's face, voice, name, or other identifying characteristic, whether that person is you or someone else. These definitions apply equally to this Terms of Service and, where referenced, to our Privacy Policy.

03 Eligibility & Accounts

To use AuraStream you must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, and capable of forming a binding contract under applicable law. By registering, you represent and warrant that this is true and that all information you provide during sign-up is accurate and kept current.

• One account per individual. Accounts are personal, non-transferable, and may not be shared, sold, rented, or used by anyone other than the person who registered them.
• You are responsible for all activity that occurs under your account, whether or not you personally authorized it, unless that activity results from our failure to maintain adequate security.
• You must provide a valid, monitored email address and keep it up to date, since it is our primary channel for account, billing, and security notices.
• We may decline to open, or may close, an account at our reasonable discretion where eligibility, accuracy, or safety requirements are not met.

04 Account Security & Verification

You are responsible for maintaining the confidentiality of your login credentials and for notifying us promptly at security@aurastreamstudio.com of any unauthorized use of your account or suspected breach. To protect streamers and prevent abuse of a real-time transformation engine, sign-up may require email verification, an automated human/bot check, and — where you choose to enable it — third-party sign-in through Google, Apple, or GitHub. We reserve the right to request additional verification for high-volume, high-risk, or previously flagged accounts, and to suspend an account temporarily while that verification is pending.

05 The Service

AuraStream provides real-time, AI-powered video transformation, letting streamers alter their appearance, background, and on-screen presentation live, on a pay-as-you-go or membership basis. Minutes are consumed based on active streaming and transformation time, not idle connection time, as measured by our own systems, which are the authoritative record for billing purposes absent manifest error.

The Service is provided on an "as available" basis, and output quality, frame rate, and processing capacity may vary with your plan tier, network conditions, device capability, and ongoing platform improvements. Because we continually refine the underlying transformation engine, the precise look of a given effect may evolve over time even where the prompt or preset name stays the same.

06 Changes, Updates & Beta Features

We may add, modify, or retire features, presets, or plan tiers at any time to improve reliability, safety, or quality. Where a change materially reduces a paid feature you rely on, we will provide reasonable notice. From time to time we may offer early-access or "beta" features clearly labeled as such; beta features are provided experimentally, may be unstable, may consume minutes at a different rate, and may be withdrawn without the notice period that applies to generally available features.

07 Acceptable Use

AuraStream exists to make live streaming more expressive, polished, and fun — never to deceive, exploit, or harm. You agree to use the Service only for lawful purposes and in a manner consistent with these Terms, and you will not use the Service to circumvent, disable, reverse-engineer, or otherwise interfere with its security, rate limits, watermarking, or content-moderation systems, or to access it through automated, bot-driven, or scraping means not expressly authorized by us.

08 Prohibited Content & Conduct

Without limiting Section 7, you specifically agree not to use the Service to:

• Impersonate a real person without their explicit, informed consent, or create content intended to defraud, defame, blackmail, or mislead viewers about a real person's identity, statements, or actions.
• Produce, request, or distribute sexually explicit content involving a real person's likeness without that person's documented consent, or any sexual or exploitative content involving a minor in any form, in any jurisdiction, under any circumstance.
• Harass, threaten, stalk, bully, dox, or incite violence or hatred against any individual or group.
• Infringe another party's intellectual property, publicity, or privacy rights, including by transforming a copyrighted character or a real person's likeness for commercial impersonation.
• Facilitate election interference, coordinated disinformation, market manipulation, or any other deceptive practice prohibited by applicable law.
• Violate consumer-protection, anti-fraud, export-control, or other applicable law in your jurisdiction or the jurisdiction of your viewers.

Enforcement. Violations of this Section may result in immediate suspension, forfeiture of unused Minutes, removal of content, and — where required by law or where we believe in good faith that someone is at risk of harm — referral to law enforcement or relevant authorities without further notice to you. We take misuse of real-time transformation technology seriously and reserve the right to review flagged sessions for policy compliance, including through automated and human moderation.

09 Likeness, Consent & Deepfake Policy

Because AuraStream can transform how a person appears on camera, consent sits at the center of how the Service may be used. You may transform your own likeness freely, subject to these Terms. You may only transform, incorporate, or feature another real person's likeness — including a co-streamer, guest, or bystander who appears in frame — where you have their clear, informed, and revocable consent to be depicted that way, and you must be able to demonstrate that consent to us on request. Depicting a real, identifiable person in a way that could reasonably deceive viewers into believing the depiction is unaltered footage of a real event that did not occur is prohibited, regardless of intent, unless clearly and conspicuously labeled as simulated, satirical, or fictional in a way a reasonable viewer would understand.

10 Minors & Child Safety

AuraStream is not directed to, and may not be used by, anyone under 18. We apply a zero-tolerance policy to any attempt to use the Service to sexualize, exploit, endanger, or generate abusive content involving a minor, whether the minor is real, implied, or stylized to appear as a minor. Any account associated with such conduct will be permanently terminated on discovery, associated content and logs preserved as evidence, and the matter reported to the National Center for Missing & Exploited Children (NCMEC) or the equivalent authority in the relevant jurisdiction, and to law enforcement, without prior notice to the account holder.

11 Your Content & the License You Grant Us

You retain ownership of your Source Content and of the Output Content generated during your session, subject to the rights of any underlying model providers as disclosed in our Privacy Policy. By using the Service, you grant AuraStream a limited, non-exclusive, worldwide, royalty-free license to process, transmit, and temporarily store your Source Content solely to operate, secure, and improve the Service — including real-time processing, quality assurance, abuse detection, and, only where you have separately and affirmatively opted in, model-improvement research. We do not sell your Source Content or Output Content to third parties, and we do not use your live video to train third-party advertising or facial-recognition products.

12 Feedback

If you send us suggestions, feature ideas, or other feedback, you grant AuraStream a perpetual, irrevocable, royalty-free license to use that feedback for any purpose, including improving the Service, without any obligation to compensate or credit you.

13 Intellectual Property

The Service, including its software, transformation models, interface designs, trademarks, and the "AuraStream" name and orb logo, is the property of AuraStream and its licensors and is protected by copyright, trademark, and other intellectual-property laws worldwide. Nothing in these Terms grants you any right in our brand, source code, model weights, or underlying technology beyond what is strictly necessary to use the Service as intended, and all rights not expressly granted are reserved.

14 Third-Party Services & AI Infrastructure Partners

Some transformation capability is powered by third-party AI infrastructure and hosting partners operating under contractual confidentiality and data-protection terms with us, as described in our Privacy Policy. You are solely responsible for complying with the terms of service of any third-party platform (Twitch, YouTube, TikTok, Discord, and similar) to which you broadcast or distribute Output Content. AuraStream is a tool provider; we do not host, endorse, or take responsibility for your outbound broadcasts or their reception on third-party platforms.

15 Payments & Pricing

Pay-As-You-Go packs and Membership plans are billed as described at checkout at the time of purchase. All prices are listed in USD unless another currency is expressly displayed, and are exclusive of applicable taxes, duties, and payment-processor fees unless stated otherwise. Prices may change prospectively for future purchases; changes never apply retroactively to Minutes or plan terms you have already paid for.

16 Minutes, Packs & Memberships

Minutes purchased under a Pay-As-You-Go pack do not expire unless clearly stated otherwise at the time of purchase. Membership Minutes renew and reset according to your billing cycle, and unused membership Minutes do not carry over to the next cycle unless your specific plan explicitly states otherwise. Minutes are a personal, non-transferable digital entitlement and have no cash value except as expressly provided under Section 18.

17 Auto-Renewal & Cancellation

Memberships automatically renew at the end of each billing period until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of your current billing period, and you retain access to membership benefits through that period without a partial-period refund except as required by applicable law.

18 Refunds & Chargebacks

Because Minutes are a consumable digital good, purchases are generally final once a session has begun. Refunds for an unused, un-started pack may be requested within 7 days of purchase by contacting billing@aurastreamstudio.com. Filing a chargeback with your card issuer without first contacting support may result in immediate suspension of your account pending review, and we reserve the right to recover disputed amounts through any lawful means where a chargeback is later found to be unwarranted.

19 Taxes

You are responsible for any sales, use, value-added, or similar taxes associated with your purchase, other than taxes on AuraStream's net income. Where required by law, applicable tax will be calculated and displayed at checkout based on your billing location.

20 Referral Program

Where enabled, our referral program credits +1 bonus Minute to your balance each time a friend you referred completes a qualifying purchase of a pack or plan, with no limit on the number of qualifying referrals. We may modify, limit, or discontinue the referral program at any time, and we reserve the right to withhold or reclaim referral credit obtained through fraudulent, automated, or abusive referral activity.

21 Availability & Performance

We aim for fast, high-definition, low-latency performance, but real-time AI video processing depends on your device, network connection, and regional infrastructure outside our control. We do not guarantee uninterrupted or error-free service, and we are not liable for interruptions caused by factors outside our reasonable control, including internet outages, third-party infrastructure failures, or force majeure events described in Section 28.

22 Suspension & Termination

We may suspend or terminate your account, with or without notice, for violation of these Terms, suspected fraud, non-payment, legal requirement, or risk to the safety of others, with notice provided where practicable and not otherwise prohibited by law. You may close your account at any time from account settings.

23 Effect of Termination

Upon termination, your right to access and use the Service ends immediately, and any unused Minutes are forfeited except where applicable law or our published refund policy provides otherwise. Provisions that by their nature should survive termination — including ownership, content licenses already granted, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

24 Disclaimers of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular transformation output will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

25 Limitation of Liability

To the fullest extent permitted by law, AuraStream's total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 3 months preceding the event giving rise to the claim. Neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence.

26 Indemnification

You agree to indemnify, defend, and hold AuraStream and its officers, employees, and licensors harmless from any claims, damages, liabilities, and reasonable legal fees arising from your misuse of the Service, your Content, your violation of these Terms, or your violation of any right of a third party, including a third party's likeness or intellectual-property rights.

27 Dispute Resolution, Governing Law & Venue

These Terms are governed by the laws of the jurisdiction in which AuraStream is incorporated, without regard to conflict-of-law principles. Before filing a claim, you agree to first attempt to resolve the dispute informally by contacting legal@aurastreamstudio.com; most concerns can be resolved this way. Any dispute that is not resolved informally within 60 days will be subject to the exclusive jurisdiction of the courts located in that jurisdiction, except where mandatory local consumer-protection law provides you with a different venue or forum.

28 Export Control, Sanctions & Force Majeure

You may not use the Service if you are located in, or are a national of, a country or region subject to comprehensive trade sanctions, or if you are listed on any applicable restricted- or denied-party list, and you agree to comply with all applicable export-control and economic-sanctions laws. Neither party is liable for any failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including natural disaster, war, act of government, labor dispute, internet or utility failure, or widespread outage of third-party infrastructure ("Force Majeure").

29 General Provisions

You may not assign or transfer these Terms or your account without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and AuraStream regarding the Service and supersede any prior agreements on the subject.

30 Changes to These Terms & Contact

We may update these Terms as the Service evolves. Material changes will be notified by email or in-app notice at least 14 days before taking effect, and continued use of the Service after that date constitutes acceptance of the revised Terms. In short: stream responsibly, respect other people's likeness and consent, keep minors out of it entirely, pay for what you use, and we will keep building the fastest, highest-quality real-time transformation engine we can.
